Resolution No. 90-4471

     A RESOLUTION DESIGNATING HIGHWAYS WITHIN THE LAKE ALMANOR WEST SUBDIVISION (CSA. No. 2)

     FOR COMBINED USE OF MOTOR VEHICLES AND GOLF

     CARTS, AND PRESCRIBING RULES AND REGULATIONS.

     WHEREAS, the residents of the Lake Almanor West Subdivision (Plumas County Service Area No. 2) have petitioned the

     board of supervisors for permission to drive golf carts on roads within the subdivision in  order to get to and from the golf course

     there; and,

 

     WHEREAS, California Vehicle Code section 21115 authorizes the Board of Supervisors to designate by resolution such roads

     for the combined use of Motor vehicles and golf carts; and,

 

     WHEREAS, the board of supervisors FINDS as follows:

     (a)    the roads of the Lake Almanor Subdivision are within the jurisdiction of the county, and are located adjacent to the 

           subdivision’s golf course or between the golf course and homes where golf carts are stored; and,

 

     (b)    all the roads of the subdivision are proximate to the golf course to the extent that it is safe for golf carts to use all the roads

           with vehicular traffic.

 

     NOW, THEREFORE, BE IT RESOLVED that, pursuant to Vehicle Code section 21115, all the roads within the Lake Almanor

     West Subdivision (Plumas County Service Area No. 2) are hereby designated for the combined use of golf carts and motor

      vehicle traffic, subject to the following rules and regulations:

 

     (1)    Golf carts must obey the prevailing speed limit;

     (2)    Golf carts operated during darkness shall be subject to equipment requirements specified in Vehicle Code section

           24001.5;

 

     (3)    Signs shall be posted along the affected roads giving notice of the combined use by golf carts and the prevailing speed

            limit;

 

     (4)    The county road department shall from time to time propose to this board such additional rules and regulations as may be

            necessary for the public safety and convenience in these circumstances;

 

     (5)    Pursuant to Vehicle Code section 21115, the county shall not enact further regulations affecting the regulations affecting

            the registration, licensing or equipment for golf carts.

     The foregoing resolution was duly passed and adopted by the Board of Supervisors of the County of Plumas, State of California,

     at a regular meeting of said board held on the 6th day of February, 1990, by the following vote:

 

     AYES:        Supervisors:  SCROGGS,  WOODHALL, SCHRAMEL, SMITH, COATES

     NOES:        Supervisors:  NONE

     ABSENT:   Supervisors:  NONE
